This Privacy Policy together with the Kaplan Privacy Center discloses the privacy practices for the websites Kaplan, Inc. and Kaplan North America, LLC (“Kaplan,” “We,” or “Us”) operate (the “Site(s)”) that link to this policy. Please note that some Kaplan businesses, subsidiaries, and affiliates may have separate privacy policies on their respective websites that you should review when visiting those websites. This policy does not apply to job applicants or personnel. Persons with disabilities may obtain this notice in alternative format by any contact method at Accessibility Support.

Your privacy is important to us and we are committed to protecting it. This Privacy Policy is designed to ensure that you are informed of how your personal information, also sometimes referred to as personal data, is used and your choices about that use, whenever you choose. By using the Site, you are consenting to Kaplan collecting and processing your personal information in the United States in accordance with this Privacy Policy, as it may be amended from time to time. Children Under the Age of 13: No one under the age of 13 may provide any information to or post any information on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not (i) use or provide any information on the Website or on or through any of its features, (ii) create an account on the Site, (iii) make any purchases without your parent through the Site, (iv) use any of the interactive or public comment features of the Site, or (v) provide any information about yourself to us. If we learn we have collected or received personal information from a child under 13, we will delete that information.

The personal information we collect about you will depend upon how you (or, if a minor with consent of your parent/guardian, how you and your parent) interact with our Sites and the information you (or, if a minor with consent of your parent/guardian, you and your parent collectively) voluntarily provide us. In addition, we may receive information about you from other sources (such as firms that use public data to make predictions) or we may collect additional types of information after providing notice to you to the extent such notice and consent is required by the U.S. state data privacy laws and obtaining your explicit consent. U.S. State Data Privacy Law Categories of Information We Collect from You & Purposes for Collection

Personal Identifiers : personal information is information that is linked or reasonably linkable to an identified or identifiable individual (also called personal identifiers), such as your name, postal address(es), email address(es), or telephone number(s). Personal information does not include data where the identity has been removed (anonymous data).

Personal identifiers are used for the following purposes:

  • Communicate with You. To communicate with you by email, chat, postal mail, telephone, and mobile devices; To respond to inquiries and inform you about products or services that may be of interest to you either from us, other Kaplan companies, or other third parties.

  • Deliver Services and Products. To deliver the products and services that you have requested; To manage your account and to provide you with customer service and support; To file reports for regulated products and to service contractual requirements; To manage our business and perform functions as otherwise described to you at the time of collection.

  • Enhance Your Needs and Understand Progression. To monitor progress and performance in the products and services. To send surveys or questionnaires so that we can learn more about your needs and interests.

  • Administer and Personalize Your Experience. We use your personal information to recommend products and services that might be of interest to you and personalize your experience; To perform data analytics alongside other data about you that we may collect outside the product or service we deliver to improve product effectiveness, learning experience, and quality.

  • Support, Improve, and Develop. To perform research and analysis about your use of, or interest in, our products, services, or content, or products, services, or content offered by others; To analyze performance, fix errors, and improve the usability and effectiveness of our products and services; To monitor and improve the services we provide.

  • Participate in Social Media. To allow you access to the Site to post comments, upload content, or communicate with others. We collect your social media handle and basic account information when you interact with our services through social media. We use this information to improve the user experience and our services. To the extent permitted by law, we retain this information for as long as we maintain an account with the social media platform.

  • Advertising and Promotions. We may use your personal information to inform you of special offers and new or existing services that we believe may be of interest to you; To provide you with information about Kaplan products or services; To send you information about select third party's products or services that may be of interest to you; To display content and advertising tailored to your interests on our Site and other sites; To verify your eligibility and deliver prizes in connection with contests and sweepstakes.

  • Comply with Legal Obligations. We may use your personal information to: Comply with laws; Perform a contract we have entered into related to your access to the product or services; Enforce our terms and conditions; Where it is needed in the public interest or for official purposes.

  • Process Payment and Fraud Prevention. We use personal information to prevent and detect fraud and abuse to protect the integrity of our content and security of our customer’s data; We may use financial information or payment method to process payment for any purchases, subscriptions, or sales made on our Site; To protect against or identify possible fraudulent transactions and otherwise as needed to manage our business; To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

  • Safety and Health. We may use personal information in case of emergency or related to your health; To make appropriate alternative arrangements for you regarding your attendance or request for accommodation.

As an education and enablement service provider with consumers from middle school through professional school, we store this information to optimize your experience with us and assist you in achieving your lifetime and career goals. To the extent permitted by law, we retain this information indefinitely as an education provider to meet state regulations for regulated programs. For unregulated programs, we retain this information indefinitely to provide lifelong learners information of interest, until we receive a request that it be deleted.

Customer Records Information is information such as name, signature, Social Security number, physical characteristics or description, passport number, driver’s license or state identification card number, education, employment, employment history, bank account number, credit or debit card number, or other financial information. Our service providers collect your bank account number, credit card number, debit card number, or any other financial information you submit to process payments, fees, charges, billing, and collections so that we fulfill your purchase. We may use this information to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. We do not retain this information in our systems. The service provider processes payment only and may not use the information for any other purpose. We may also collect information regarding your education, occupation, and language preference to optimize additional products and services that may be of interest to you. To the extent permitted by law, we retain this information indefinitely to provide lifelong learners information of interest and opportunities for development, until we receive a request that it be deleted. For certain programs regulated by the state for the profession, we use this information to verify your identity when taking examinations as required by the state, such as your Social Security number or driver’s license. We later delete any Social Security numbers (except for the last four digits) on a monthly basis after the state’s reporting requirements have been met and only if the state regulations permit such deletion.

Characteristics of protected classifications under California (Sensitive Information), Colorado (Sensitive Data), Connecticut (Sensitive Data), Utah (Sensitive Data), Virginia (Sensitive Data), or federal law are racial or ethnic origin, religion, sexual orientation, gender identity, gender expression, mental or physical health condition or diagnosis, citizenship or immigration status, or age. Additionally, in Colorado, Connecticut, and Utah sensitive data also includes genetic or biometric data for the purpose of uniquely identifying an individual, or personal data from a known child (and in Connecticut and Utah, additionally precise geolocation if processing to identify a specific individual). Except for collection of age on certain Sites that sell products for children that is used to screen for children under the age of 13 and to obtain appropriate consents from minors over the age of 13, we do not request any other data in this category from you or from a known child. We do not share Sensitive Data with third parties.

Commercial information are records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We may collect information about online activity data, products or services purchased or considered, or other purchasing or consuming histories or tendencies to provide you with information, products, or services that you request from us and to improve them. To the extent permitted by law, we retain this information indefinitely to provide lifelong learners information of interest and opportunities for development, until we receive a request that it be deleted.

Biometric information is hair color, eye color, fingerprints, height, retina scans, facial recognition, voice, and other biometric data according to California law. In Connecticut and Virginia, biometric data means data generated by automatic measurements of an individual's biological characteristics, such as a fingerprint, a voiceprint, eye retinas, irises, or other unique biological patterns or characteristics that are used to identify a specific individual. In Connecticut and Virginia, "biometric data" does not include (A) a digital or physical photograph, (B) an audio or video recording, or (C) any data generated from a digital or physical photograph, or an audio or video recording, unless such data is generated to identify a specific individual. We do not collect biometric information. In summary, we may collect a driver’s license or official ID to authenticate your identity if you take professional certification or licensing examinations as required by the state.

Internet or other electronic network activity information is browsing history, search history, and information regarding a consumer’s interaction with an Internet website, application, or advertisement. We automatically collect information about your browsing history and your interaction with the content of our Sites or services to measure activity, determine the effectiveness of our services, and improve them. We retain this information indefinitely at a de-identified, aggregate level.

Sensory Data is audio, electronic, visual, thermal, olfactory, or similar information. We collect your audio or voice recordings if your program is recorded as part of the delivery of services or randomly when you telephone us for quality assurance and internal review. We retain program recordings for the benefit of other participants in the program, internal research, and quality assurance. We delete the quality assurance recordings after approximately 5 years. We delete program recordings after approximately 7 years.

Geolocation Data is precise location as may be determined by GPS or IP address. We do not collect precise geolocation data.

Professional or Employment-related Information. We collect information on professional license numbers or membership information, certifications, licenses, or credentials to assess the offerings that may assist you in maintaining your professional certification and to report continuing education to the state oversight agency for the profession. To the extent permitted by law, we retain this information indefinitely to continue to service your continuing education needs.

Nonpublic Education Information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). We collect information in education records (such as attendance, grades, performance, official exam scores, proctoring conditions, communications, usage, and completion data) as a state-authorized education provider or when providing support services for an educational institution. To the extent permitted by law, we retain this information as an education provider to meet state regulations for regulated programs.

Inferences Drawn from Other Personal Information. We collect information from sources other than you to build a consumer preference profile and characteristics to determine how best to serve you over your lifetime, how you may achieve success when using our products, and how we may modify our offerings for the success of others. Some of this information is collected at a household level such as number of children or estimated household income. To the extent permitted by law, we retain this information indefinitely to provide lifelong learners information of interest and opportunities for development, until we receive a request that it be deleted.

Profiling Information. According to the Colorado Privacy Act, the Connecticut Data Protection Act, and the Virginia Consumer Data Protection Act, profiling information means any form of automated processing performed on personal data to evaluate, analyze, or predict personal aspects related to an identified or identifiable individual's economic situation, health, personal preferences, interests, reliability, behavior, location, or movements. We may collect information from sources other than you to build a consumer profile of your preferences (to determine how best to serve you over your lifetime, how you may achieve success when using our products, and how we may modify our offerings for the success of others.) We do not profile as defined by the Colorado Privacy Act, the Connecticut Data Protection Act, and the Virginia Consumer Data Protection Act. Any details about consumer preferences, if compiled, is to understand your preferences for services we offer and not used for any automated decision making that would produce legal or similarly significant effects concerning you.

What We Collect from Sources Other Than You

We may also obtain Personal Information about you from the sources below:

  • Third-Party Contractors: such as schools, employers, or other third parties who purchase or make an arrangement with us on your behalf for your use of Kaplan products or services, or use of an affiliate’s services or benefits, or if an agent refers you to Kaplan.

  • Third-Party Business Partners: such as joint marketing partners;

  • Third-Party Applications: such as blogs or chat rooms or social networks

  • State Regulatory Authority for the Profession: such as license exam pass data from the oversight agency for the profession;

  • Data Analytics Firms: such as market research or market intelligence firms, data augmentation, and data aggregators

Data from Automated Technology

We use various technologies to collect information from your computer and about your use of the Site.

Information collected automatically. We automatically collect information from your browser when you interact with our Site. This information includes, but is not limited to, your IP address, your browser type and language, access times, the content of any undeleted cookies that your browser previously accepted from us (see "Cookies" below), and the referring website address.

Cookies. When you visit our website, we use cookies to allow you to move quickly through our site, to allow you to take advantage of some of the Site's password-protected features, and to collect information about your use of the Site. Cookies also benefit you by creating a more streamlined login process and keeping track of your language of choice between sessions, among other things. As we enable further customization of the site, cookies will help in assuring that the information provided to you will be relevant to your needs.

A cookie is a string of information that is sent by a website and stored on your hard drive or temporarily in your computer's memory. Cookies are small files and won't pose any significant disk-space concerns. Other Technologies. Like many websites, we may use standard Internet technology, such as web beacons, site tags, clear GIFs, and other similar technologies, to collect and maintain information about your web-surfing activity when you are visiting this Site, other Kaplan sites, as well as other non-Kaplan sites. We also may include web beacons or pixel tags in connection with some Site pages and HTML-formatted email messages to, among other things, compile aggregate statistics about Site usage and response rates. A pixel tag is an electronic image, often a single pixel that is ordinarily not visible to Site visitors and may be associated with cookies on the visitors’ hard drive. Pixel tags allow us to count users who have visited certain pages of the Site, to deliver branded services, and to help determine the effectiveness of promotional or advertising campaigns.

Do-Not-Track Disclosures. Some web browsers may transmit “do-not-track” (DNT) or Global Privacy Control (GPC) signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. Through its vendor OneTrust, Kaplan honors DNT and GPC signals in all US states. Globally, Kaplan will interpret the browser "do not track" signal as an opt-out signal of the sale of personal information to the US Privacy API.

Third Parties with Which We Share Information

We do not sell your Personal Information to third parties and do not knowingly sell Personal Information of consumers younger than the age of 16.

We may share your Personal Information with:

  • Authorized service providers: These providers perform services on our behalf and may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, providing assessments, performing business and sales analysis, supporting our website functionality, and supporting contests, sweepstakes, surveys, and other features offered through our website. These service providers may be supplied with or have access to your personal information solely to provide these services to us or on our behalf. Service providers are restricted from using Personal Information for any purpose unrelated to our engagement.

  • Business Partners: When you make purchases or registrations or engage in promotions offered through our Site or our services, we may share personal information with the businesses with which we partner to offer you those products, services, promotions, contests, and sweepstakes. When you elect to engage in a particular merchant’s offer or program, you authorize us to provide your email address and other information to that merchant.

  • Other Kaplan Businesses: We may share your personal information with Kaplan companies as part of our regular reporting activities on company performance, in the context of a business reorganization or group restructuring exercise, or for system maintenance support and hosting of data. Sharing contact information with our Kaplan companies enables us to provide you with information about a variety of products and services that might interest you.

  • Government Agencies, Courts of Law, and Law Enforcement: We may disclose your Personal Information in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.

  • Regulators: We may need to share your Personal Information with a regulatory state agency that oversees our regulatory products and the profession.

  • Other Parties in Connection with a Corporate Transaction: We may also disclose Personal Information in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, internal reorganization, or in the unlikely event of bankruptcy.

  • Aggregated Data: We also may share other information with third parties (either Identified or Anonymized) to improve products, services, and the learning experience, such as data augmentation using third-party data sources to personalize the services. We may also share personal information with third parties to develop and deliver targeted advertising on our websites and websites of third parties. We may combine nonpersonal information we collect with additional nonpersonal information collected from other sources. We also may share aggregated information with third parties, including advisors, advertisers, and investors, to conduct the general business analysis.

  • Parents and Guardians: If you are a minor, we may share your Personal Information with your parents or guardians to seek authorizations, deliver services or perform a contract, comply with our legal obligations, and if it is in your vital interests.

International Residents

The Website is intended for U.S. residents. There are separate privacy policies on other Kaplan websites that serve international consumers that you should review when visiting those websites. The contracts Kaplan enters into with third-party suppliers or where we provide services to organizations in other countries require that the supplier or organization respects the data privacy rights of international residents in accordance with their country’s laws.

EU/UK Residents Privacy Rights

The Website is intended for U.S. residents. If, however, you are a resident of the EU/UK then you have additional privacy rights, which are explained at EU/UK Privacy Rights.

Transfer of Data Outside of Your Home Country

Your Personal Information will be held in the United States. Your Personal Information may also be stored, processed, and accessed in other countries where Kaplan has facilities or where you are located. You consent to the transfer of your Personal Information outside your country, including to the United States.

SMS Terms and Conditions

Please review these SMS Terms & Conditions (the “SMS Terms”) carefully. By signing up for a text program or registering your phone number(s) with Kaplan or otherwise agreeing to receive text messages from or on behalf of Kaplan, you agree to these SMS Terms.

How to Opt Out and Get Help: To stop receiving text messages from Kaplan, you may reply STOP to the number sending the message. After replying STOP, you may receive additional communications confirming that your request has been received and processed, and you may continue to receive text messages for a short period while your request is processed. If you need further assistance, text HELP to the number sending the message, or contact customer service at 800-KAP-TEST (800-527-8378). In all cases, consent to receive texts is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency will vary but will be generally four to six messages per month.

Opting into Text Messages: By opting into any text program, you expressly consent to receive recurring text messages that may be sent using an automatic telephone dialing system, by or on behalf of Kaplan, at the cell phone number you provide us. By voluntarily providing your cell phone number to Kaplan, you consent to receive marketing, transactional, operational, or informational text messages at that phone number. Please note we may not be able to deliver messages to all mobile carriers. Consent to receive texts is not a condition of purchasing any goods or services, and you understand and agree that all text messages may be sent using automated technology.

Major Participating Carriers : Major mobile carriers are supported. Mobile carriers are not liable for delayed or undelivered messages.

Cost : Message and data rates may apply for any messages sent to you from or on behalf of Kaplan, and messages you send to us. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Eligibility and Change in Phone Number : By providing your cell phone number to Kaplan, you warrant that you are at least 18 years of age (or the age of majority in your state) or older. You further warrant that you are the current subscriber or authorized user of the phone number you have provided. You agree that you will not initiate messages to the mobile phone of any other person or entity without authorization. If you change, forfeit, or deactivate the phone number you have provided to Kaplan, you agree to notify Kaplan immediately. Failure to do so constitutes a material breach of these SMS Terms.

Social Media Privacy

Kaplan will not require you to:

  • Disclose a username or password for accessing personal social media;

  • Access personal social media in the presence of Kaplan’s employees or representatives; or

  • Divulge any personal social media information.

User Submissions

We may provide sections on the Site where you can post information about yourself and others and communicate with others; upload content (e.g., pictures, videos, audio files, etc.); and post comments or reviews of content found on the Site. Such postings may appear on other websites or when searches are executed on the subject of your posting. Whenever you voluntarily disclose personal information on publicly viewable web pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution concerning your personal information. Once you have posted information, you may not be able to edit or delete such information.

Data Security

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, destroyed, used or accessed in an unauthorized way, altered, or disclosed. Also, we limit access to your personal information to those employees, service providers, business partners, agents, and other third parties who have a legitimate need to know. They will only process your personal information on our instructions or as otherwise agreed and they are subject to a duty of confidentiality. However, as effective as these security measures are, no security system is impenetrable. We cannot guarantee the security of our systems, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet.

There are some places on the Site or through our services where you may click on a link to access other websites that do not operate under this Privacy Policy. These third-party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. Kaplan makes no representation about their data practices or policies.

Storage and Retention of Your Personal Information

We will only retain your information for as long as necessary to fulfill the purposes we collected it for, including to satisfy any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information; The potential risk of harm from unauthorized use or disclosure of your personal information; the purposes for which we process your personal information and whether we can achieve those purposes through other means; and the applicable legal requirements. No Rights of Third Parties

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the website.

Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy any time and from time to time. We will notify you of changes by posting changes here, or by other appropriate means. Any changes to the Privacy Policy will become effective when the updated policy is posted on the Site. Your use of the Site and products or services or your provision of information to us following such changes indicates your acceptance of the revised Privacy Policy.
